LA dock workers battle over jobs intensifies

DOCK workers at the Los Angeles and Long Beach ports last Friday protested against a partial work stoppage ordered by a group representing West Coast terminal operators, saying it will slow down the unloading of cargo by several days.

But the terminal operators’ group, Pacific Maritime Association, countered that there is not enough room at the terminals, with cargo piling up due to the dock workers’ union, the International Longshore and Warehouse Union, Local 13, withholding the workers needed to move cargo out of the terminals and onto trucks.

On Friday night, for the first time, only one in three dock workers got a job assignment. Officials predict that will more than triple the amount of time it takes to unload a cargo ship.

‘I think that’s irrational, it doesn’t make any sense. We’re trying to work, we’re not here to hurt anybody or anything,’ dock worker AJ Jackson said. ‘We’re just workers who’ve got family, children, all that stuff. We’re not here to do anything except come do this job, and they’re cutting that. That’s terrible.’

The ILWU is in the midst of contentious negotiations with the PMA over labour contracts for West Coast dock workers.

The spat prompted Los Angeles Mayor Eric Garcetti and Long Beach Mayor Robert Garcia to jointly urge both sides to back off, and to consider the effect of their negotiating tactics on the economy.

‘Negotiations resume Monday and it’s in no one’s interest for either side to take further actions before then,’ they said.

They added the twin ports ‘play a critical role in our regional and national economy, and so those at the table bear a responsibility that extends far beyond the waterfront.’

‘The prudent course of action is to keep people working and keep goods moving as negotiations continue,’ Garcetti and Garcia said.

Other city leaders also raised concerns over the row, with Los Angeles City Councilman Joe Buscaino saying the longer that ‘protracted contracted labour negotiations’ continue, ‘the more damage will be inflicted on our national and local economies’.

‘I have many family and friends on both sides of the issue and urge each to be fair and come to an agreement as quickly as possible,’ said Buscaino, who represents the harbour area.

Representatives of ILWU, Local 13, said the PMA issued a ‘surprise’ directive on New Year;s Eve telling terminal operators to cut the number of workers tasked with unloading ships.

‘If this irresponsible PMA action stands and operators follow, it will take eight to 10 days to unload a ship instead of the normal two and a half days,’ Bobby Olvera, president of Local 13, said. ‘The post-holiday season is time to catch up on the tremendous backup of ships waiting to be unloaded at the Ports of Los Angeles and Long Beach. It’s been this way for years.’

PMA officials said they are cutting the number of workers because there is not enough space at the terminals to unload cargo onto.

‘It makes no sense to maintain the pace of removing containers from ships when there’s no room for them on the terminals,’ PMA spokesman Wade Gates. ‘If a parking lot were full, you would clear out empty spaces before bringing in more cars. The same rule applies here.’

Gates blamed ILWU for the congested terminals, saying the union has been preventing qualified crane operators, whose job is to get cargo out of the terminals and onto trucks, from coming to work as part of a negotiating tactic.

‘Removing qualified yard crane drivers from terminal operations is the equivalent of a football coach sending out 10 players and no quarterback,’ Gates said. ‘You can’t run the play effectively. The congestion in the terminals is near a breaking point.’

An ILWU spokesman said the union was not withholding workers, and said there are not enough qualified crane operators because training has been reduced.

Gates said PMA is not budging on the directive to reduce the number of workers unloading ships.

The prolonged labour negotiations between port operators and dockworkers became significantly more acrimonious on Friday when both sides made accusations of bad-faith labour tactics, which no doubt will compound congestion already crippling the twin ports of Long Beach and Los Angeles.

Although neither side came out and said they were on the verge of declaring a strike or a lockout, the mayors of Los Angeles and Long Beach reacted quickly to the news by sending out a joint statement asking the International Longshore and Warehouse Union and Pacific Maritime Association, the latter of which represents port managers in labour talks, to avoid escalating the conflict.

‘Negotiations resume Monday and it’s in no one’s interest for either side to take further actions before then,’ Los Angeles Mayor Eric Garcetti and Long Beach Mayor Robert Garcia said in the statement.

‘The Ports of Los Angeles and Long Beach play a critical role in our regional and national economy, and so those at the table bear a responsibility that extends far beyond the waterfront. The prudent course of action is to keep people working and keep goods moving as negotiations continue,’ the statement continued.

• More than 2,500 Kaiser Permanente mental health clinicians are preparing for a weeklong strike starting January 12.

Psychologists, therapists and social workers represented by the National Union of Healthcare workers are planning to picket Kaiser’s Fontana, Ontario and Riverside medical centers as well as 32 other locations statewide, said Justin DeFreitas, a union spokesman.

The union, which has been without a contract for four years, charges that Kaiser’s staffing in the mental health arena has not kept pace with increasing patient loads – some of that resulting from the Affordable Care Act.

‘A bad situation has been made even worse,’ DeFreitas said.

Asked for comment, Kaiser Permanente officials issued this statement: ‘We want to assure our members and our communities that Kaiser Permanente’s priorities are the safety of our members and patients and the continued delivery of high-quality care and service.

‘To that end, we are preparing to implement comprehensive contingency plans throughout the region to ensure the continued care, service, and safety of our members and patients before, during, and after the work stoppage expected on January 12.’

The union ranks include 108 members in Fontana, 107 in Riverside and 56 in Ontario, DeFreitas said.

In 2013, Kaiser Permanente was fined $4 million by the California Department of Managed Health Care for failing to provide adequate mental health services.

It was reportedly the second largest fine in the history of the agency.

In a prepared statement, the union compared the situation to last year’s scandal at the Veterans Administration, where long delays in receiving medical care became a national issue.

In contract negotiations in December, Kaiser Permanente’s mental health clinicians presented Kaiser with what the union termed a ‘commonsense solution’.

It was the creation of clinician-management committees in each facility that can work together to determine adequate staffing levels and outsourcing needs.

If the two sides cannot agree, an outside expert would be summoned.

‘But once again, Kaiser failed to act, triggering this statewide strike,’ the union said.
